1. Introduction

(a) Website Owner. OurEarth.org, Inc. (“OurEarth”) is the owner of this website. This online privacy notice discloses OurEarth’s information practices for this website, including what type of personal identifiable information is requested in order to contact a visitor seeking information or making a donation, how the information is used, and with whom the information is shared.

(b) Website Visits. In general, you can visit the OurEarth website without disclosing any personal information. OurEarth analyzes the data gathered from website visits for trends and statistics, and then OurEarth discards the gathered data.

(c) Website Transactions. At times, OurEarth will need personal information regarding a donor, moderator, or a person seeking information. For example to process an online donation, OurEarth may need to know a donor's name, mailing address, e-mail address and credit card details. It is OurEarth's intent to inform you now before OurEarth collects personal information, such as user's name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, OurEarth will respect your wishes.

2. Personal Information That May Be Collected

(a) Identifying Information. In order to make a donation or to access designated subscriber services and /or restricted areas within the OurEarth website, OurEarth will request a user to provide certain personal identifying information, which may include: name, postal address, e-mail address, screen name, password, telephone number, method of payment, and, if applicable, credit card number. OurEarth may request additional information necessary to establish and maintain user's account.

(b) OurEarth does not collect or maintain information from users actually known to be under the age of 13, and no part of OurEarth's Web sites are structured to attract anyone under the age of 13.

(c) OurEarth will help keep your personal information accurate. If a user's personal information has changed, please e-mail the new information to OurEarth at the e-mail address shown in paragraph 1(a) above. If a user would like to review the personal information OurEarth has in its files regarding the user, e-mail your request to OurEarth together with the description of a recent donation.

(d) Chat Rooms, Forums and Bulletin Boards. If a user participates in an OurEarth chat room, discussion forum, or posts messages to an OurEarth bulletin board, user should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside OurEarth, who have access to that chat room, forum or bulletin board. Some individual OurEarth chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Also, participant's expressed opinion is his or her own and should not be considered as reflecting the opinion of OurEarth.

(e) Links to Other Web Sites. An OurEarth website may contain links to other websites. OurEarth is not responsible for the privacy practices or the content of those other websites.

3. Uses Made of the Information

(a) Limited Uses Identified. Without user's prior consent, OurEarth will not use your personal identifiable information for any purpose other than that for which it is submitted. OurEarth uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and in program record-keeping. OurEarth also processes billing and business requests related to OurEarth Web Site participation.

(b) Marketing Uses. The information you provide to the OurEarth website may also be collected, used, analyzed and/or processed by OurEarth, or selected third parties on OurEarth's behalf, for marketing and other business purposes. Before OurEarth uses the information, however, OurEarth will notify users and offer users the opportunity to opt-out if a user wishes not to have personal identifying information used in this way.

(c) Stored Information Uses. OurEarth stores and retains the information provided by donors or moderators. Stored information is used by OurEarth: to support moderator interaction with the OurEarth website; to deliver requested information; and/or to contact donor regarding recent donations.

4. Disclosure of the Information

(a) Within Corporate Organization. OurEarth may share your personal information within the OurEarth corporate organization, and may transfer the information to countries in the world where OurEarth conducts business. Some countries may provide less legal protection for user personal information. In such countries OurEarth will still handle user personal information in the manner describe herein.

(b) OurEarth never shares, sells or rents your personal information without prior notice to user and the opportunity to opt-out.

(c) Agents. OurEarth employs or engages other companies and individuals to perform business functions on behalf of OurEarth. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, processing credit card payments and providing visitor services.

(d) Marketing Analysis by Third Parties. OurEarth reserves the right to disclose to third parties personal information about users for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual user.

(f) OurEarth may release personal information to appropriate governmental authorities where release is required by law (for example, a subpoena) or by a regulation, or is requested by a government agency conducting investigations or proceedings.

5. Use of Computer Tracking Technologies

(a) OurEarth's website is not set up to track, collect or distribute personal information not entered by visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but, again, the statistics contain no personal information and cannot be used to gather such information.

(b) Use of Cookies. OurEarth, or its third party vendors, collect non-identifiable and personal information through the use of various technologies, including ”cookies.” A cookie is an alphanumeric identifier that a website can transfer to user's hard drive through user's browser. The cookie is then stored on user's computer as an anonymous tag that identifies the user's computer, but not the user. Cookies may be sent by OurEarth or its third party vendors. User can set its browser to notify user before a cookie is received, giving an opportunity to decide whether to accept the cookie. User may also set its browser to turn off cookies; however, some Websites may not then work properly.

(c) Use of Web Beacon Technologies. OurEarth may also use web beacon or other technologies to better tailor its website to provide better user service. If these technologies are in use, when a visitor accesses these pages of the website, a non-identifiable notice of that visit is generated which may be processed by OurEarth or by its suppliers. Web beacons usually work in conjunction with cookies. If user does not want cookie information to be associated with user's visits to these pages, user can set its browser to turn off cookies; however, web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

(d) Collection of Non-Identifiable Information. OurEarth may collect non-identifiable information from user visits to the OurEarth website in order to provide better user service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on OurEarth website; website and system administration; user analysis; and business decision making. Such information is sometimes known as ''clickstream data.'' OurEarth or its contractors may use this data to analyze trends and statistics.

(e) Collection of Personal Information. OurEarth collects personal identifying information from a donor during a donation and a moderator at sign-up. OurEarth may extract some personally identifying information about that transaction in an non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help OurEarth understand trends and patterns. This information is not reviewed at an individual level.

6. Information Security

(a). OurEarth intends to protect user personal information and to maintain its quality. To achieve information security and quality, OurEarth implements appropriate measures and processes, such as using encryption when transmitting certain sensitive information.

(b) No Liability for Acts of Third Parties. OurEarth will exercise all reasonable efforts to safeguard the confidentiality of user personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, OurEarth shall not be liable for unauthorized disclosure of personal information due to no fault of OurEarth including, but not limited to, errors in transmission and unauthorized acts of OurEarth staff and/or third parties.

7. Privacy Policy Changes and Opt-Out Rights

(a) Changes to Privacy Policy. This privacy notice was last updated on June 29, 2011. OurEarth reserves the right to change or update its privacy policy statement at any time. A notice of any material change will be posted on the OurEarth Website home page for 10 days prior to the implementation of such change.

(b) Opt-Out Right. Any donor or moderator has the right at any time to cease permitting personal information to be collected, used or disclosed by OurEarth and/or by any third parties with whom OurEarth has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting OurEarth via e-mail, telephone, or certified postal mail. After processing the cancellation, OurEarth will delete user or prospective user's personal information from its data base.

8. Access Rights to Data

(a) Information Maintained by OurEarth. Upon user's request, OurEarth will provide a reasonable description of user's personally identifiable information that OurEarth maintains in its data bank. (b) Corrections and Changes to Personal Information. Help OurEarth to keep user personal information accurate. (a) Questions, Problems and Complaints. If you have a question about this policy statement, or a complaint about OurEarth compliance with this privacy policy, you may contact OurEarth by e-mail.

(b) Terms of Use. If a visitor chooses to make a donation, become a moderator, or to request information, user's action is hereby deemed acceptance of OurEarth practices described in this policy statement. Any dispute over privacy between user and OurEarth is subject to the provisions of this notice and to OurEarth's Terms of Use Agreement which is hereby incorporated herein and which can be read at http://www.ourearth.org/about/terms.htm.
